This collection consists of records related to Richard Sheppard Arnold’s consideration for two U.S. Supreme Court vacancies and Attorney General of the United States. Arnold was a well-respected Judge for the U. S. Court of Appeals for the Eighth Circuit. The files contain handwritten notes, reports, biographies, memorandum, clippings, articles, email, and correspondence recommending Richard Arnold’s nomination to replace Harry Blackmun on the Supreme Court.

The materials in FOIA 2006-0188-F are a selective, not necessarily all inclusive, body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. FOIA request 2006-0188-F contains materials from several White House staff offices and individuals, the majority being the White House Office of Records Management (WHORM) Subject Code FG051 and the White House Counsel’s Office. Within the first two years of assuming office, President Clinton nominated many high level officials including an Attorney General and two Supreme Court Justices. Among many potential nominees was fellow Arkansan, Richard Sheppard Arnold, 1936 – 2004. Arnold was a well respected Judge for the U. S. Court of Appeals for the Eighth Circuit. Ultimately, Janet Reno would be named Attorney General, and Ruth Bader Ginsburg and Stephen Breyer would be named to the vacancies on the Supreme Court. The White House Office of Records Management (WHORM) Alpha Files contains correspondence recommending Richard Arnold’s nomination to replace Harry Blackmun on the Supreme Court. There is correspondence from Arnold regarding a conference invitation. In addition, Arnold corresponds with Mack McLarty recommending an individual for appointment within the General Services Administration (GSA). The WHORM Subject Categories for this particular request contains six different subject file classifications. These categories include correspondence from both individuals seeking government employment and individuals recommending others for appointments. The majority of the White House return correspondence was produced by J. Victoria Biggins, Director of Presidential Personnel. FG006- 01, FG006-04, FG050, FG051, and PE002 contains correspondence specifically related to judicial recommendations. The majority of this correspondence is recommendations for Richard Arnold to be nominated to the Supreme Court in 1993 and 1994. Whereas, ME, contains recommendations and general correspondence for many different individuals, including Arnold. The White House Staff and Office Files contain correspondence, handwritten notes, reports, biographies, memorandum, clippings, and articles maintained by individual staff members. The files from the Counsel’s Office of Bernard Nussbaum consist of handwritten notes, reports, biographies and memorandum discussing potential Supreme Court and Attorney General Nominees. The files of Victoria Radd contain memorandum, recommendation letters, articles, and clippings regarding the Supreme Court justice search. However, the majority of Counsel’s Office material is currently withheld under Presidential Records Act and Freedom of Information Act restrictions. The Automated Records Management System (ARMS) Emails contains wire reports, including ―The Hotline,‖ White House News Reports, press releases and news analysis. This material details various news stories of the day including many articles related to potential Supreme Court and Attorney General Nominees. The NSC Cable, Email, and Records Management Systems contain no relevant records

Records responsive to this FOIA request were found in four collection areas—Clinton Presidential Records: WHORM Alpha Files, Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: ARMS Emails. As policy, Staff and Office Files are processed at the folder level. That is, individual documents are not selected and removed from a folder for processing. WHORM Subject files are processed at the document level. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. 

Collection is open to all researchers. Access to Clinton Presidential Records is governed by the Freedom of Information Act (FOIA) (5 USC 552 as amended) and the Presidential Records Act (PRA) (44 USC 22) and therefore records may be restricted in whole or in part in accordance with legal exemptions.

Official records of William Jefferson Clinton’s presidency are housed at the Clinton Presidential Library and administered by the National Archives and Records Administration (NARA) under the provisions of the Presidential Records Act (PRA).
