The nuts and bolts of the nomination process can be seen in correspondence, memoranda, reports, lists, notes, and papers that highlight the contributions of the Counsel’s Office to the easy manner in which the two nominees breezed through confirmation proceedings in the Senate. The writings of the two justices in the form of scholarly articles, speeches, interviews, decisions, and opinions are documented in extensive detail. A sizable portion of the records is devoted to Breyer’s investment in Lloyd’s of London—much of which has been closed for reasons of privacy. Scope and Content Note The materials in FOIA 2006-1067-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. FOIA 2006-1067-F contains records relating to President Clinton’s decision to nominate Ruth Bader Ginsburg and Stephen Gerald Breyer to the U.S. Supreme Court. At the time of their selection, they were widely regarded as deserving nominees who would bring considerable skill and knowledge to one of the nation’s most influential bodies. Clinton wanted to leave a lasting legacy with his choices, and by selecting moderates, such as Ginsburg and Breyer he placed on the court individuals with a similar outlook on the more important issues of the day. The President nominated Ginsburg on June 14, 1993; she took the oath of office on August 10, 1993. Breyer’s nomination occurred on May 13, 1994; he took the oath of office on August 3, 1994. Ruth Bader Ginsburg emerged as the nominee in President Clinton’s first appointment to the Supreme Court to replace retiring Supreme Court Justice Byron White. Ginsburg had been the co-founder of and chief litigator for the Women’s Rights Project of the American Civil Liberties Union (ACLU), which provided her with the experience of arguing four cases before the Supreme Court, all dealing, in some way with gender discrimination. In 1980, Ginsburg was appointed as a judge to the U.S. Court of Appeals for the District of Columbia Circuit, where she served for thirteen years. Notably, Ginsburg was one of only nine women in a Harvard Law School class of over five hundred, and the first female to serve on both the Harvard Law Review and the Columbia Law Review. She was confirmed by a vote of 96-3 vote in the Senate. Stephen Gerald Breyer was nominated by President Clinton for a seat on the U.S. Supreme Court in 1994 following the retirement of then-Justice Harry Blackmun. Breyer had served as a Special Counsel and Chief Counsel to the U.S. Senate Judiciary Committee during the 1970s, and had been a Judge on the U.S. Court of Appeals for the First Circuit during the 1980s, becoming the Chief Judge for the Court in 1990. Breyer had also been a member of the United States Sentencing Commission from 1985-1989, helping to create the Federal Sentencing Guidelines which allowed for greater standardization where federal criminal sentencing procedures were concerned. Breyer had been one of the top names under consideration for President Clinton’s first Supreme Court appointment which, in the end, went to Ginsburg. When Blackmun announced his retirement on April 6, 1994, he once again emerged as a major name under consideration. Breyer received the nomination and was confirmed by a vote of 87-9 in the Senate. The material in this particular FOIA case was generated by a number of groups and individuals. Much of it came from Lloyd’s of London because of Judge Breyer’s decision to invest in the world famous underwriting agency. Records also came from other outside organizations such as the American Bar Association (ABA) in the form of questionnaires and evaluations concerning Ginsburg and Breyer. Other valuable information flowed into the White House from specific individuals such as Professor Paul Gewirtz of Yale University and Gerhard Casper of Stanford University, who wrote in detail defending the decisions of the two nominees. The White House Office of Records Management (WHORM) Subject Category for the Supreme Court contains correspondence, memoranda, clippings, and resumes largely from the general public, Congress, and members of the Clinton Administration. WHORM Subject File FG051 relates to the Supreme Court and letters in support of and against Ginsburg and Breyer can be found here. They are voluminous in nature and often times quite detailed and discerning. The White House Staff and Office Files contain correspondence, memoranda, publications, clippings, lists, reports, and copies of writings by the two nominees in the offices of individual staff members. In the case of Ginsburg, questionnaires she filled out, transcripts of her hearings, and lists of people attending her swearing-in ceremony can be found in Counsel’s Office files not attributed to any specific staffer. The files of Doug Band include copies of Ginsburg’s published opinions, writings, and speeches. Additional information about Ginsburg’s work in the lower courts is located in the records of Victoria Radd. Her cases are listed with docket numbers and much more in the way of specifics. The papers of Breyer include information related to his membership on Lloyd’s of London. At the time he invested in the renowned company, most experts considered such a move to be sound and certain to lead to thousands of dollars in profit. Many Americans had poured a lot of money into Lloyd’s. However, financial conditions in the 1970s and 1980s (in the form of losses from hurricanes and lawsuits involving asbestos) caused investors in Lloyd’s to lose millions and look for ways to extricate themselves from the mess. Due to complications, Breyer couldn’t get out until 1994. This constituted one of the few controversial issues in his nomination to the Supreme Court. The White House Staff and Office Files for Breyer contain records similar to those of Ginsburg—forms, correspondence, copies of writings, transcripts, speeches, and interviews. General Counsel’s Office files consist of travel records for Breyer and questionnaires he filled out dating back to when he first began hearing cases in 1965. In the papers of Doug Band there can be found financial disclosure reports for Breyer and clippings about his decisions as Judge of the Court of Appeals for the First Circuit. The files of Cliff Sloan, the attorney responsible for shepherding Breyer’s nomination through the Senate, highlight his activities in Lloyd’s on a year-by-year basis and the key role he played as a member of the United States Sentencing Commission in the overhauling of federal sentencing guidelines. Automated Records Management System [Email] (ARMS) records responsive to this FOIA request include emails sent out by White House staffers concerning a background briefing related to Justice Ginsburg’s nomination and emails sent out by White House staff members with information about Justice Ginsburg. Record Type Textual System of Arrangement Records that were responsive to this FOIA request were found in these collection areas—Clinton Presidential Records: WHORM Alpha Files, Clinton Presidential Records: WHORM Alpha Project, Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: White House Staff and Office Files, and Clinton Presidential Records: ARMS Emails. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Alpha File was compiled by the White House Office of Records Management from 1993-1996 and is a series of documents arranged by name of persons, organizations, or events. The WHORM Subject File was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. In addition, there are WHORM, WHORM (Counsel), WHORM (CL), WHORM (OP), WHORM (Too Late), WHORM (Various Offices), and WHORM (Alpha Project) Series. Staff and Office Files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas, Staff and Office Files are processed at the folder level, that is individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS dataset is comprised of 6 sub-series of email records called “Buckets.” The buckets include NPR, OPD, POTUS, WHO, CEA, and Default. ARMS emails are arranged chronologically by creation date.
