This collection contains records relating to cannabis, primarily regarding the legitimacy of marijuana as a medical treatment. The records include correspondence from medical marijuana advocates, drafts of responses to public correspondence, newspaper clippings, drug use statistics, drafts of the December 30, 1996, federal response to state-level legalization of medical cannabis, and records relating to Conant v McCaffrey. The collection also contains records regarding the Clinton Administration’s efforts to address international drug production and trafficking, including cannabis. These include Congressional correspondence and lists of major drug producing and drug trafficking countries.

The materials in FOIA 2022-0069-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related material. Since the enactment of the Controlled Substances Act (CSA) in 1970, there have been many efforts to legalize the use of cannabis in the treatment of chronic pain, glaucoma, arthritis, migraines, epilepsy, as well as the pain, nausea, and lack of appetite associated with chemotherapy and AIDS. Advocates for the legalization of medical cannabis began gaining ground in the early 1990s, particularly in the state of California. A combination of local and state propositions led to California reclassifying cannabis as a Schedule II drug at the state level and calling upon the federal government to pass legislation allowing the medical prescription of cannabis. In 1996, California passed Proposition 215 - the Compassionate Use Act of 1996, which allowed the medical cultivation, possession, and use of cannabis by patients with a physician’s recommendation. In that same year, Arizona passed Proposition 200, which allowed physicians to prescribe cannabis to their patients. Arizona’s medical use provision was largely ineffective, however, due to the language used in the proposition being in direct conflict with the language of the Controlled Substances Act. The Clinton Administration, primarily through the work of the Director of the Office of National Drug Control Policy Barry McCaffrey, remained firmly opposed to the medical use of cannabis, and in December of 1996 released a comprehensive federal response to state-level cannabis legalization. This response included the intent to revoke the Drug Enforcement Administration’s authorization to prescribe from physicians who prescribed or recommended medical cannabis, and to exclude them from Medicare and Medicaid programs. A group of licensed physicians from California claimed that these threats infringed upon their First Amendment rights. They prevailed in September 2000 as the case Conant v McCaffrey affirmed their right to recommend (though not prescribe) cannabis to their patients. Records that are responsive to this FOIA request were found in these collection areas—Clinton Presidential Records: WHORM Alpha Files, Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: White House Staff and Office Files, and Clinton Presidential Emails: NSC Cable, Email, and Records Management System. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Alpha file was compiled by the White House Office of Records Management from 1993 – 1996 and is a series of documents arranged by name of persons, organizations, or events. The WHORM Subject file was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. In addition, there are WHORM, WHORM Counsel, WHORM (CL), WHORM (OP), WHORM (Too Late); WHORM (Various Offices); and WHORM (Alpha Project) series. Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area.
