This collection consists of material concerning three pieces of legislation: the Violent Crime Control and Law Enforcement Act of 1994, the Brady Bill, and the Assault Weapons Ban. The collection contains correspondence, memoranda, newspaper articles, reports, publications, drafts of speeches, lists, notes, papers, legal briefs, cables, and emails. These materials also include letters from President Clinton to members of Congress, constituents, and law enforcement organizations thanking them for their support in getting tough crime bills passed. The collection also contains substantive memos detailing the Congressional strategy and lists those wishing to witness the signing of these laws. Lastly, there are cables from overseas embassies assessing how foreign countries viewed the 1994 Omnibus Crime Bill and emails pertaining to the potential importation of banned assault weapons.

The materials in FOIA 2009-1305-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related material. FOIA 2009-1305-F contains records dealing with Crime Bill, the Brady Bill, and the Assault Weapons ban. The Brady Handgun Violence Prevention Act, commonly referred to as the Brady Bill or Brady Act, subjected all firearm purchasers in the United to mandatory federal background checks. It also put into effect a five-day waiting period on firearm transactions. This last provision became obsolete with the advent of the NICS [National Instant Criminal Background Check System] in 1998. According to a report released in 2012, 92% of all Brady background checks conducted through the NICS reach a resolution while the FBI is still on the phone with the gun dealer. Originally, the Brady Bill was introduced into the House of Representatives in 1991. On that occasion it never came up for a vote. Two years later the legislation was reintroduced and received the full approval of Congress in November. At the end of the month, President Clinton signed the bill into law. On February 28, 1994, the Brady Bill finally went into effect. The Brady Bill was named for James Brady, the press secretary for President Reagan, who was seriously wounded in John Hinckley, Jr.’s assassination attempt on March 30, 1981. Shot in the head, Brady remained partially paralyzed until his death thirty-three years later. Sarah Brady, the wife of James, became involved in the gun control movement within a few years of the shooting. Both James and Sarah Brady attended the ceremony at which President Clinton signed the act. According to the Chief Executive, “If it hadn’t been for them [i.e. the Bradys], we would not have passed the Brady Law.” The Federal Assault Weapons Ban (AWB), referred to officially as the Public Safety and Recreational Firearms Use Protection Act, came into existence as a subsection of the Violent Crime Control and Law Enforcement Act of 1994. Its two main provisions prohibited the manufacture for civilian use of both certain categories of semi-automatic firearms designated as assault weapons and specific ammunition magazines deemed to be “large capacity.” The ban went effect on September 13, 1994, the day the bill gained the approval of Congress and also received the signature of President Clinton. Ten years later to the day, on September 13, 2004, the act died. Between 2003 and 2008 several attempts were made in Congress to reauthorize the ban. None of these bills made it out of committee. Described by one expert as “the most comprehensive criminal justice legislation in U.S. history,” the Violent Crime Control and Law Enforcement Act of 1994, or the Crime Bill of 1994, consisted of 356 pages. Senator Joe Biden from Delaware was recognized as the primary author; Representative Jack Brooks of Texas was seen as the principal sponsor; Congress passed the act with votes from both Democrats and Republicans; President Clinton wasted little time in signing the bill into law. Provisions included authorizing the COPS [Community Oriented Policing Services] Office to hire 100,000 more police officers to put out on the nation’s streets, a Semi-Automatic Firearms Ban that lasted for ten years (1994-2004), the elimination of inmate higher education by not permitting Pell Grants to be awarded to “any individual who is incarcerated in any Federal or State penal institution,” the VAWA [Violence Against Women Act] receiving $1.6 billion to “help prevent and investigate violence against women,” “boot camps” for juvenile delinquents, and the setting aside of a substantial amount of money to build new prisons. Records that were responsive to this FOIA request included correspondence, lists, memoranda, newspaper articles, notes, drafts of speeches, reports, charts, graphs, faxes, publications, handwritten notes, and papers. There were many meetings and signing ceremonies connected with anti-crime legislation and the like. Law enforcement organizations such as the Fraternal Order of Police (FOP), National Association of Police Organizations (NAPO), and International Association of Chiefs of Police (IACP) sent representatives to the White House on a regular basis; their names ending up on lists. There are also lists of Senators and Representatives supportive and opposed to gun control, legislators who might be persuaded to change opinions, and employees from the various national departments and agencies attending the signing ceremonies. The WHORM [White House Office of Records Management]-Subject File included all manner of correspondence from President Clinton. He wrote to members of Congress who voted in favor of either the Brady Bill, the Federal Assault Weapons Ban, or the Crime Bill of 1994. Constituents declaring their support of these acts sometimes received thank you letters from the White House. Executives of groups—the Federal Law Enforcement Officers Association (FLEOA), as a case in point—were recipients of notes from the President congratulating them on everything they “did to help us pass a crime bill and the ban on assault weapons in the House of Representatives.” Other materials that are in this collection encompass a wide variety of records. Memoranda involving bill passage strategy, speeches by President Clinton, and newspaper articles heavily annotated by his own hand appear throughout the WHORM-Subject File. The bulk of the White House Staff and Office files appear to be mainly in Cabinet Affairs, Chief of Staff, Communications, Counsel’s Office, Domestic Policy Council, Intergovernmental Affairs, and Public Liaison. The files of Christine Varney of Cabinet Affairs contain calendars and monthly planners centered around activities connected to the Crime Bill of 1994, an entire series of documents entitled “Daily Talking Points on Anti-Crime Legislation,” issue briefings pertaining to crime prevention programs in the crime bill conference report, and concise summaries for each state detailing the money to be spent on law enforcement and prevention programs. Varney’s papers specifically focus on Operation Safe Home, a new initiative put forward by the Clinton Administration. An interagency approach designed to combat violent crime and fraud in public housing, this innovative policy proposal received a thorough analysis and treatment in newsletters, memoranda, and talking points. The material from the files of the Chief of Staff contain memoranda, fact sheets, notes, faxes, drafts, newspaper articles, lists, correspondence, handwritten notes, charts, and graphs. Jody Greenstone’s papers have records describing the strategy to be pursued in Congress with respect to timing and other factors in getting crime legislation passed, outlining the major segments of the Violent Crime Control and Law Enforcement Act of 1994 (Substantive Criminal Provisions, Immigration Initiatives, Grant Programs for 1995, and Grant Programs for 1996-2000), and listing the attendees at a Crime Bill implementation meeting on October 8, 1994. Mack McLarty, who served briefly as Chief of Staff has a few folders containing a letter from Senator John Kerry to President Clinton giving his recommendations for a crime bill package and a booklet entitled “Crime and Violence: Briefing Synopsis.” The Communications files primarily consist of publications, fact sheets, correspondence, press releases, drafts of speeches and addresses, notes, memoranda, and newspaper articles. The files of Mark Gearan contain records designed to get across to the public the basic components of President Clinton’s anticrime package. A case in point would be a document with the working title of “Questions and Answers on Clinton Initiatives to Expand Community Policing and Reduce Gun Violence.” An in-depth investigation of Newt Gingrich’s record on crime can be seen as a sequence of fact sheets. They show all the votes the Speaker of the House missed that had anything to do with drugs, hate crimes, the death penalty, etc. The papers of Ann Walker contain a series of lengthy memoranda for Attorney General Janet Reno concerned with how specific newspapers viewed the accomplishments of the Clinton Administration. These compositions served as briefings for her as she met with editors all across the country regarding the Crime Bill of 1994. The Counsel’s Office records consist principally of memoranda, publications, newspaper articles, correspondence, handwritten notes, and papers. Containing a publication entitled “Department of the Treasury Study on the Sporting Suitability of Modified Semiautomatic Assault Rifles,” the files of Karen Pop seem to be focused on the banning of assault weapons. They name particular rifles and pistols, even showing photos of what is under discussion. Letters exchanged between the Bureau of Alcohol, Tobacco, and Firearms and international gun dealers show that applications to import certain weapons were denied on the basis of not meeting the sporting weapons test. In other words, the guns in question were deemed to be semi-automatic assault weapons. The papers of Clarissa Cerda contain memoranda in which legal matters are hashed out in detail. For example, one aspect of the implementation of the Crime Bill of 1994 is a “Presidential Declaration of Violent Crime and Drug Emergency Areas.” Cerda advises that such an action should be taken promptly so as to “avoid practical problems and political embarrassment.” The papers of Stephen Neuwirth are primarily concerned with legal challenges to the Assault Weapons Ban and some provisions of the Brady Bill having to do with background checks. Domestic Policy Council contains the records of such key advisors as Dennis Burke, Jose Cerda, and Christa Robinson. In the files of Burke there is material designated as “The Clinton Crime Plan—As Distributed at the October 12, 1993 Crime Meeting.” Talking points, press releases, presidential directives on federal firearm licensing and assault pistols, newspaper articles, and speeches and radio addresses by President Clinton can be found here. The files of Cerda contain much in the way of documentation related to the Brady Bill. There is correspondence with local officials concerning how the law should be put into effect, accounts of roll call votes in Congress vis-à-vis the legislation, and statements by cabinet members along the lines of “Attorney General Janet Reno on Arkansas’ Decision to Permit Law Enforcement Officers to Continue Conducting Background Checks on Purchasers of Guns.” Much of Robinson’s papers are devoted to the accomplishments of the Clinton Administration in the area of crime. Newspaper articles, fact sheets, statistics, and speeches by President Clinton point out accomplishments related to crime. Intergovernmental Affairs, concentrated almost exclusively in the files of Marcia Hale, contains lists, memoranda, correspondence, and press releases. The letters consist of correspondence between prominent members of Congress (like Bob Dole) and influential mayors and governors (like Rudy Giuliani and Thomas Carper) concerning the effectiveness of the Crime Bill of 1994. There is a sense of urgency about getting this act passed and out on the streets. The records of Christopher Wayne constitute the majority of the records in Public Liaison files. Most of these take the form of lists. These lists seemingly were never finalized. They contain numerous handwritten additions, usually with the note that “this is the last of the add-ons, I promise.” The records from the National Security Council are primarily concerned with the Legislative Review process and other administrative topics including the reception of gun control efforts in overseas capitols and how the ban on certain types of weapons may affect trade with certain countries.

Records that were responsive to this FOIA request were found in these collection areas—Clinton Presidential Records: White House Office of Records Management (WHORM) Subject Files, Clinton Presidential Records: WHORM (CL), Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: ARMS Emails, Clinton Presidential Records: TRP Emails, and Clinton Presidential Records: NSC Cable, Email, and Records Management Systems. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track correspondence. The WHORM Subject File was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. In addition, there are WHORM, WHORM Counsel, WHORM (CL), WHORM (OP), WHORM (Too Late), WHORM (Various Offices), and WHORM (Alpha Project) series. Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS database is comprised of six sub-series of email records called "buckets." The buckets generally represent a specific White House office. The buckets are titled: NPR for National Performance Review, OPD for Office of Policy Development, POTUS for President of the United States, WHO for White House Office, CEA for Council of Economic Advisers, and Default for emails not associated with an office The Tape Restoration Project (TRP) is a database consisting of restored emails from the Automated Records Management System (ARMS) from July 1994 through June of 2000. The TRP is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential record email. The TRP database is comprised of the same six sub-series of email as in ARMS. TRP emails are arranged by topic, there-under by bucket, and there-under chronologically by creation date.
