It contains correspondence, memoranda, talking points, drafts, invitations, background material, agendas and minutes, executive orders, speeches, informational packets, travel documents, emails, cables, reports, and press materials regarding a variety of issues related to the fight against HIV/AIDS. The topics addressed include the Haitian detention crisis, federal budget, foreign aid, collaboration with other governments, international agencies (such as WHO and the UN) and NGOs, international conferences, a Presidential Mission to Africa, pharmaceutical companies, tuberculosis, individual countries, and some crossover domestic issues, such as dealing with HIV positive persons in the US military and the inclusion of the virus as an excludable illness under the Immigration and Naturalization Act. The records of the National AIDS Policy Office make up the bulk of the collection. Scope and Content Note The materials in FOIA 2007-1550-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. The Centers for Disease Control (CDC) first identified Acquired Immunodeficiency Syndrome (AIDS) in 1982. Within two years, Human Immunodeficiency Virus (HIV) was generally acknowledged as the cause of AIDS. By the time President Clinton took office in 1993, more than 30 million people were living with this fatal disease worldwide. Of those infected with AIDS in 1993, 20 million cases were in Africa alone. President Clinton established the White House National AIDS Policy Office as an early response to the AIDS pandemic. This office provided policy guidance on the Federal Government’s response to the national and international AIDS pandemic. Three people served as director of this office during the Clinton Administration: Kristine Gebbie (1993-1994), Patricia Fleming (1994-1997) and Sandra Thurman (1997-2001). Sandra Thurman also became the Presidential Envoy for AIDS Cooperation in 2000. The Counsel’s Office files of Steve Neuwirth and Kathleen Whalen, as well as the files of Alexis Herman in the Public Liaison’s Office, contain records related to the establishment of this office. The Subject File also contains correspondence authored by the National AIDS Policy Office. This Subject File correspondence discusses the Presidential Mission to sub-Saharan Africa in 1999, problematic situations with AIDS prevention in South Africa in 2000, international studies on and solutions to HIV transmission, participation in international meetings and conferences on AIDS, and strategy such as the Leadership and Investment in Fighting an Epidemic (LIFE) AIDS initiative. Shortly after taking office, President Clinton was confronted with the case of HIV-positive Haitian refugees being held at Guantanamo Bay Naval Base, Cuba. In January of 1993, 267 of these refugees protested their continued detainment with a hunger strike. After a district court order in June of 1993, the Clinton Administration negotiated the parole of the refugees into the United States. Although the National Institutes of Health Revitalization Act of 1993 allowed for vaccine research of the virus, the Act also codified this HIV-positive immigration exclusion. The immigration ban stayed in effect until January 2010. The detention of HIV-infected Haitian political refuges at Guantanamo is described in several different areas of records. Memorandums, correspondence, and press clippings in the general files of the National AIDS Policy Office and files of Chief of Staff Mack McLarty, National Security Council (NSC) Legal Advisor Mary Derosa, Eric Schwartz in the NSC Multilateral and Humanitarian Affairs Directorate, and NSC Staff Director Nancy Soderberg regard these Haitian refugees. The Subject File contains letters from both Members of Congress and domestic organizations, in addition to White House memos, concerning the detention of HIV-infected Haitian political refugees at Guantanamo. Subject File correspondence from members of Congress, local and state governments, and domestic organizations addresses AIDS and immigration in a more general sense, namely in terms of listing AIDS as a communicable disease banning entry to the United States. Throughout the 1990s, Sub-Saharan Africa was the international epicenter of the AIDS pandemic. Thus, sub-Saharan Africa was also the epicenter of the global community’s effort to fight this regional crisis. Uganda and Senegal exhibited relative success in slowing the expansion of AIDS. South Africa was characterized by alarming infection rates of the HIV virus. The situation in South Africa presented additional challenges to the global response to AIDS. In 2000, President Thabo Mbeki questioned the causal link between HIV and AIDS, as well as the widely-used antiretroviral therapy. The international community feared Mbeki’s controversial statements would undermine AIDS treatment and prevention efforts. In addition, a trade dispute between the United States and South Africa arose over intellectual property rights protections and a country’s acquisition of inexpensive AIDS treatments. After protests from advocacy groups over the United States’ initial defense of these protections, President Clinton signed Executive Order 13155 in May 2000. This order stated that “the United States shall not seek…the revocation or revision of any intellectual property law or policy of a beneficiary sub-Saharan African country…that regulates HIV/AIDS pharmaceuticals or medical technologies if the law or policy of the country.” In addition to the Executive Order, the Clinton Administration increased aid to the subSaharan Africa region, particularly through the LIFE initiative in 2000. Fully two-thirds of records in this segment related to the US reaction to the AIDS pandemic in SubSaharan Africa and international cooperation are found in the general staff and office working files of the National AIDS Policy Office and specifically in the records of Patsy Fleming, Mary May, Sandy Thurman and Kenneth Bernard of the National AIDS Policy Office. Included also are files of the NSC African Affairs Directorate, the NSC Legal Advisor Daniel Shapiro, and the NSC International Health Affairs Directorate. Records consist of correspondence, memoranda, talking points, drafts, invitations, Clinton Presidential Library’s web site 2007-1550-F http://www.clintonlibrary.gov 3 background material, testimony, speeches, agendas and minutes, executive orders, informational packets, travel documents, emails, cables, reports and press materials. Topics include the federal budget, foreign aid, compulsory licensing, collaboration with other governments and international agencies (such as the United Nations, the World Bank, and the World Health Organization), orphans, Mother to Child Transmission (MTCT), working with influential individuals and non governmental organizations, international conferences, a Presidential Mission to Africa, and negotiations with pharmaceutical companies. Correspondence in the Subject File also focuses on AIDS in Africa. Such correspondence is authored by a variety of entities, including the Congressional Black Caucus, other Members of Congress, and international groups such as the Joint United Nations Programme on HIV/AIDS (UNAIDS). Topics in the Subject File correspondence include affordability and availability of AIDS drugs in Africa, children orphaned by AIDS, debt relief, drug studies, human rights, legislative solutions, and the spread of AIDS beyond Africa. Letters signed by President Clinton within the Subject File regard the Executive Order on accessibility and affordability of AIDS drugs in Africa, the National AIDS Policy Office’s mission in sub-Saharan Africa, and international conferences held in Africa. During the second half of the Clinton Administration, the main thrust of the international community shifted to a coordinated effort to prevent the spread of the disease and effective treatment of those already affected. Beginning in Denver in 1997, the member countries of the Group of Eight committed themselves to assisting in AIDS treatment, research, and prevention initiatives. Combatting AIDS was a part of the US-Japanese Common Agenda and an area of cooperation between the US and the European Union. Financial aid to poor nations was an integral part of a global strategy to stop the spread of HIV. The World Bank and the Multilateral Development Banks funded loans to developing nations for AIDS projects. In the United States, the Export-Import Bank and US Agency for International Development (USAID) also funded projects in countries struggling with the pandemic. The 1999 Cologne Debt Initiative included AIDS prevention as one of its targets. Congress passed the Global AIDS and Tuberculosis Relief Act of 2000, which allocated $300 million for a trust fund to assist the World Bank in funding efforts to slow the pandemic in Africa. As the number of people living with AIDS climbed to 36 million in 2000, and began increasing more rapidly in Southeast Asia, the United Nations Security Council held its first session on the pandemic. Later that spring, the Clinton Administration formally recognized AIDS as threat to national security, and the NSC Deputies Committee met to discuss the pandemic in this context. The general staff files of the National AIDS Policy Office as well as the files of Lael Brainard in the National Economic Council, John Duncan and Richard Samans in the NSC International Economic Affairs directorate, and the NSC Multilateral and Humanitarian Affairs Directorate contain memorandums, correspondence, and reports regarding global aid and cooperation. Furthermore, records specific to the 2000 Deputies Committee meeting and the Global AIDS and Tuberculosis Relief Act are located in the NSC Records Management System area. In the Subject File, correspondence to President Clinton from Members of Congress, the Congressional Black Caucus, the Presidential Advisory Council on HIV/AIDS, private companies, international and national organizations and local governments regard assistance for global HIV/AIDS programs. Such assistance includes increased funding for the USAID global program, development of vaccinations, and participation in conferences and events for AIDS. Also, letters authored by the Clinton Administration within the Subject File describe administrative efforts in combating AIDS across the globe, including funding efforts, tax incentives, and vaccination initiatives. In addition to the textual materials described in this aid, the NSC Emails dating from February 12, 1993 through June 2, 1997, and processed in response to this FOIA request, also address all of these topics. Some of these emails describe the discussion of the pandemic in regards to the public remarks of the President and First Lady Hillary Rodham Clinton when travelling internationally, particularly in Eastern Clinton Presidential Library’s web site 2007-1550-F http://www.clintonlibrary.gov 4 Europe, Africa, and Southeast Asia. Subject Files also contain proclamations and remarks describing the Clinton Administration’s public framing of AIDS as an international problem, namely in regards to annual World AIDS Day. Subject File materials include background materials, drafts, and edits regarding World AIDS Day. The email from the Automated Records Management System and the Tape Restoration System are from, to, and between White House staffers on the topics of AIDS/HIV policy worldwide. A majority of the email consist of press briefs and listserv materials. The files of Steve Neuwirth in the Counsel’s Office, David Peterman and Richard Beardsworth in the NSC Defense Policy Directorate, and Marsha Dimel in the NSC Administrative Office describe the impact of HIV/AIDS on domestic policy. Issues in these files regard awareness of AIDS in the federal workplace and the discharge of HIV-positive servicemen. Record Type Textual System of Arrangement Records that are responsive to this FOIA request were found in these collection areas— Clinton Presidential Records: White House Office of Records Management (WHORM) Alpha Project, Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: WHORM (OP), Clinton Presidential Records: WHORM Various Offices, Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: ARMS Emails, Clinton Presidential Records: TRP Emails and Clinton Presidential Records: NSC Cable, Email, and Records Management Systems The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Alpha file was compiled by the White House Office of Records Management from 1993 – 1996 and is a series of documents arranged by name of persons, organizations, or events. The WHORM Subject file was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. In addition, there are WHORM, WHORM Counsel, WHORM (CL), WHORM (OP), WHORM (Too Late); WHORM (Various Offices); and WHORM (Alpha Project) series. Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas, Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS database is comprised of six sub-series of email records called "buckets." The buckets generally represent a specific White House office. The buckets are titled: NPR for National Performance Review, OPD for Office of Policy Development, POTUS for President of the United States, WHO for White House Office, CEA for Council of Economic Advisers, and Default for emails not associated with an office. The NPR bucket contains email created or received by an individual with a National Performance Review (NPR) White House user account. The OPD bucket contains email created or received by an individual with an Office of Policy Development (OPD) White House user account. The POTUS bucket was designated for email created and received by the President of the United States (POTUS). The WHO bucket contains email created or received by individual with an Executive Office of the President White House user account not identified as CEA, NPR, or OPD. The CEA bucket contains email created or received by an individual with a Council of Economic Advisors (CEA) White House user account. The Default bucket contains email created or received by unknown or un-recognized email accounts. Email found within the Default bucket often includes email created or received by offices or individuals outside the Executive Office of the President. ARMS emails are arranged by topic, there-under by bucket, and there-under chronologically by creation date. The Tape Restoration Project (TRP) is a database consisting of restored emails from the Automated Records Management System from July 1994 through June of 2000. The TRP is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential record email. The TRP dataset is comprised of 6 sub-series of email records called “Buckets.” The buckets include NPR, OPD, POTUS, WHO, CEA, and Default. ARMS emails are arranged chronologically by creation date.
