This collection consists of records related to the re-authorization of the Intermodal Surface Transportation Efficiency ACT (ISTEA) and the Clinton Administration’s proposed bill to address reauthorization, the National Economic Crossroads Transportation Efficiency Act (NEXTEA). The collection contains material concerning ISTEA, NEXTEA, BESTEA and TEA-21. The records include briefing papers, correspondence, charts, emails, memoranda, handwritten notes from briefings and meetings, press clippings, publications, reports, talking points and speeches, remarks, and statements by the President.

The materials in FOIA 2015-0463-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related material. This collection consists of records related to the re-authorization of the Intermodal Surface Transportation Efficiency ACT (ISTEA) and the Clinton Administration’s proposed bill to address reauthorization, the National Economic Crossroads Transportation Efficiency Act (NEXTEA). The Intermodal Surface Transportation Efficiency ACT (ISTEA) was passed in 1991 and expired September 30, 1997. ISTEA authorized Federal highway and mass transit construction, transportation safety initiatives, and travel alternatives (ex. bikeways and pedestrian paths). Further, ISTEA included the environmental initiative, the Congestion Mitigation and Air Quality (CMAQ) Improvement Program. CMAQ authorized funds under ISTEA to promote cleaner fuels and pollution reduction. Reauthorization proved to be too complicated and controversial to resolve before the expiration date and House and Senate passed a short-term extension providing authorization until May 1, 1998. At the center of the controversy was the Highway Trust Fund. Rep. Bud Shuster (R-PA) favored increased funding for ISTEA using the Highway Trust Fund Highway Account, which receives money through federal fuel tax. Further, Shuster proposal would have cut other discretionary programs and reduced tax cuts. President Clinton submitted National Economic Crossroads Transportation Efficiency Act (NEXTEA) to expand and improve ISTEA programs. NEXTEA proved influential in building off of Congressional efforts to address re-authorization, but ultimately did not make it through the legislative process. NEXTEA was introduced in the Senate by Sen. Daniel Patrick Moynihan (D-NY) and Sen. John Chaffee (R-RI) and in the House by Rep. Bud Shuster (R-PA). NEXTEA kept ISTEA’s Interstate Maintenance Program, National Highway System Program, Surface Transportation Program, Bridge Program, and Federal Lands Highway Program. NEXTEA increased CMAQ funding to $1.3 billion annually, expanded funding to scrap higher-polluting older vehicles, and ensured no loss of CMAQ funds related to the Environmental Protection Agency's proposed changes in air quality standards. It also increased transportation enhancements related to the cultural, aesthetic, and environmental aspects of the transportation system. NEXTEA proposed Border Crossing and Trade Corridors Program, Transportation Infrastructure Program, and Intelligent Transportation System (ITS) Incentive Program. The ISTEA re-authorization bill, ISTEA II (S. 1173), was introduced in September of 1997. In March of 1998, the Senate amended ISTEA II and on April 8, 1998 the U.S. House of Representatives passed BESTEA (H.R. 24000). BESTEA provided 218 billion over six years for transportation programs. BESTEA was passed May 22, 1998. The Administration threatened to veto the bill because the bill had become too expensive, more specifically the Administration was concerned with how ISTEA spending would be off set. The Administration held that BESTEA’s budget placed social security, education, child care, and the environment at risk. The threat of veto brought Republican leaders to the negotiating table and they agreed to work with Administration to address offsets. The House and Senate agreed to tie annual spending to Highway Trust Fund gas tax receipts from the previous year. On May 22, 1998 the U.S. Senate and House of Representatives adopted the Transportation Equity Act for the 21st century (TEA-21). TEA-21 provided 204 billion over 6 years President Clinton signed the TEA-21 on June 9, 1998. The subject files and the staff and office files contain material concerning ISTEA, NEXTEA, BESTEA and TEA-21. The records include briefing papers, correspondence, charts, emails, memoranda, handwritten notes from briefings and meetings, press clippings, publications, reports, talking points and speeches, remarks, and statements by the President. Some topics that are addressed in the materials are: seat belt laws, .08 blood alcohol levels, motorcycle helmet laws, flexible highway infrastructure safety, national highway system, federal lands, recreational trails, bridges, toll roads, tunnels, ferries, bicycle transportation, and pedestrian walkways. Some of the reports are; “A Federal Credit Program for Surface Transportation”, “Outlining a Federal Credit Program for Surface Transportation”, “ISTEA Reauthorization: Highway and Transit Legislative Proposals in the 105th Congress, 2nd Session”, “CRS Report for Congress: Transportation Funds: Budgetary Treatment”, “Surface Transportation Reauthorization: Budget and Policy Issues”, “Shaping America’s Surface Transportation System for the 21st Century”, and “Daily Report for Executives”. The records also contain correspondence and discussion materials on the Disadvantaged Business Enterprise (DBE), Welfare to Work, CMAQ, and “Access to Jobs”. The DBE was established in 1982 and when it was reauthorized in 1987 it included women owned business enterprises. The reauthorization of DBE allowed equal opportunities for women and minorities to compete for highway and transit contracts. ISTEA discussions also covered urban economic revitalization, which addressed community friendly transportation opportunities for welfare recipients, urban environmental quality, brownfield restoration, and community quality of life. Automated Records Management and Tape Restoration Project Email systems contain emailed correspondence concerning ISTEA reauthorization and NEXTEA. Records from the OPD and WHO bucket contain email correspondence containing discussion of changes to various forms of legislation related to the re-authorization. The OPD and WHO buckets contain the most responsive email concerning policy development. These buckets contain drafts of NEXTEA and talking points concerning re-authorization. Email is often exchanged to and from Andrea Kane (Domestic Policy Council), Dorothy Robyn (Domestic Policy Council, Economic Policy), Frank Raines (Director of OMB), Jessica Gibson, and Jeffrey Forbes (legislative Affairs). A key issue of discussion for documents found in the OPD and WHO buckets is the .08 Blood Alcohol provision. This provision withheld funds for highway constructions from states that did not adopt .08 blood alcohol concentration standards. A few documents of interest found in the WHO bucket include talking points concerning the Administration’s position following increased ISTEA budgets under H.R. 2400 and S. 1173, a memorandum to the President from Office of Management and Budget Director, Frank Raines providing a status update concerning negotiations with congress on the ISTEA re-authorization, and a memorandum for the President from Jack Lew (Director of OMB) and Larry Stein (Legislative Affairs) advising the President on his decision to veto H.R. 2400. Email from the Default bucket contains weekly reports to POTUS and the Chief of Staff from Rodney Slater (Secretary of Transportation) and Carol Browner (Administrator, Environmental Protection Agency).

Records that are responsive to this FOIA request were found in these collection areas— Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: WHORM (OP), Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: ARMS Emails, and Clinton Presidential Records: TRP Emails. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Subject file was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. In addition, there are WHORM (OP). Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas, Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS database is comprised of six sub-series of email records called "buckets." The National Transportation Efficiency Act buckets generally represent a specific White House office. The buckets are titled: NPR for National Performance Review, OPD for Office of Policy Development, POTUS for President of the United States, WHO for White House Office, CEA for Council of Economic Advisers, and Default for emails not associated with an office. The OPD bucket contains email created or received by an individual with an Office of Policy Development (OPD) White House user account. The WHO bucket contains email created or received by individual with an Executive Office of the President White House user account not identified as CEA, NPR, or OPD. The Default bucket contains email created or received by unknown or un-recognized email accounts. The CEA bucket contains email created or received by an individual with a Council of Economic Advisors (CEA) White House user account. Email found within the Default bucket often includes email created or received by offices or individuals outside the Executive Office of the President. ARMS emails are arranged by topic, there-under by bucket, and there-under chronologically by creation date. The Tape Restoration Project (TRP) is a database consisting of restored emails from the Automated Records Management System (ARMS) from July 1994 through June of 2000. The TRP is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential record email. The TRP database is comprised of the same six sub-series of email as in ARMS. TRP emails are arranged by topic, there-under by bucket, and there-under chronologically by creation date.
