Scope and Content Note The materials in FOIA 2014-0550-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. Larry Klayman founded Judicial Watch in 1994, and Freedom Watch in 2008. Klayman’s own biography states that “[he] is known for his strong public interest advocacy in furtherance of ethic in government and individual freedoms and liberties.” In 1998 Washington Post reporter, David Segal wrote of Klayman, “Armed with broad-ranging subpoena power by a federal judge and backed by money from an anti-Clinton Foundation, Klayman himself has become a kind of permanent, privately funded independent counsel, pioneering - Democrats would say abusing – the use of civil Lawsuits as a political weapon against the administration.” Segal further quotes Klayman as saying, “Unfortunately in this world, people don’t take you seriously unless you threaten litigation.” Judicial Watch’s website states that “Judicial Watch, Inc. is a conservative, non-partisan educational foundation, promotes transparency, accountability and integrity in government, politics and the law. Through its educational endeavors, Judicial Watch advocates high standards of ethics and morality in our nation’s public life and seeks to ensure that political and judicial officials do not abuse the powers entrusted to them by the American people. Judicial Watch fulfills its educational mission through litigation, investigations, and public outreach.” Under Klayman’s leadership, Judicial Watch brought 18 civil lawsuits against the Clinton administration. In 1998 Robert Jackson of the Los Angeles Times wrote that civil law suit that gained Judicial Watch the most notoriety was the suit filed against the Commerce Department, alleging that the Department failed to respond to Freedom of Information Act Requests for records related to overseas trade missions. Jackson wrote that Judicial Watch also notably filed an “invasion-of-privacy lawsuit against the White House for obtaining hundreds of FBI files on former GOP appointees.” Larry Klayman left Judicial Watch in 2004 to run in the Republican primary for the United States Senate in Florida. Email communication includes but is not limited to weekly reports to the President or Staff Secretary from the Commerce Department and the Department of Justice that contains a reference to Judicial Watch. Specifically, weekly reports from Commerce Secretary include a section describing the Freedom of Information Act (FOIA) requests received for the week. FOIA requests made by Judicial Watch and Klayman are reported in these Commerce Department Reports. The email collection also contains transcripts of Press Secretary press briefings and press releases that respond to questions concerning Klayman or Judicial Watch civil suits. The collection includes many emailed transcripts of television news interviews and political panels. These transcripts often include the statements of Klayman, speaking on behalf of Judicial Watch. The collection further includes published articles related to Klayman or one of the civil suits brought by Judicial Watch against the Clinton administration. Other responsive electronic records are located in the National Security Council Cables and Emails. These primarily contain press clippings, transcripts of news shows, and transcripts of White House press briefings which mention Klayman, Judicial Watch, or one of the civil suits. Record Type Textual System of Arrangement Records that are responsive to this FOIA request were found in these collection areas- Clinton Presidential Records: WHORM Subject Files, Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: Automated Records Management System [Email], Clinton Presidential Records: Tape Restoration Project [Email], and Clinton Presidential Records: NSC Cables, Emails, and Records Management System. Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas, Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS database is comprised of six sub-series of email records called "buckets." The buckets generally represent a specific White House office. The buckets are titled: NPR for National Performance Review, OPD for Office of Policy Development, POTUS for President of the United States, WHO for White House Office, CEA for Council of Economic Advisers, and Default for emails not associated with an office. The NPR bucket contains email created or received by an individual with a National Performance Review (NPR) White House user account. The OPD bucket contains email created or received by an individual with an Office of Policy Development (OPD) White House user account. The POTUS bucket was designated for email created and received by the President of the United States (POTUS). Please note that President Clinton never used his POTUS White House user account to send the few emails he wrote while in office. The WHO bucket contains email created or received by individual with an Executive Office of the President White House user account not identified as CEA, NPR, or OPD. The CEA bucket contains email created or received by an individual with a Council of Economic Advisors (CEA) White House user account. The Default bucket contains email created or received by unknown or un-recognized email accounts. Email found within the Default bucket often includes email created or received by offices or individuals outside the Executive Office of the President. ARMS email are arranged by topic, there-under by bucket, and there-under chronologically by creation date. The Tape Restoration Project (TRP) is a database consisting of restored emails from the Automated Records Management System (ARMS) from July 1994 through June of 2000. The TRP is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential record email. The TRP database is comprised of the same six sub-series of email as in ARMS. TRP email are arranged by topic, there-under by bucket, and there-under chronologically by creation date.
