This collection consists of profile sheets, correspondence, and press regarding the National Counterintelligence Policy Board's report on unauthorized media leak disclosures from March 1996. The correspondence is between President Clinton and various members of Congress regarding the media leaks. The press consists of press briefings concerning the release of the report. NSC Records Management Office profile sheets are also included. The majority of this FOIA case is currently withheld under FOIA restrictions.

The materials in 2012-0187-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. In the spring of 1995, several media outlets published an article regarding a classified program in foreign countries. In response to that story and other recent media leak cases, President Clinton called upon Cabinet and Agency heads to review their procedures for safeguarding sensitive information, including steps to discipline employees where appropriate. Several cases were referred to the Justice Department for possible investigation by the FBI. Also requested by the NSC, the National Counterintelligence Policy Board (NACIPB) was directed to review the Intelligence Community’s capacity to identify, refer, and handle unauthorized disclosures to the media. After an interagency review, the NACPIB’s final report was issued in March 1996. In the White House Staff and Office files, the majority of the documents related to this FOIA are located in National Security Council’s records. In the Intelligence Programs directorate, relevant material is located in the files of Edward Appel. However, many of the records related to this FOIA are closed for national security reasons. The records open in these files are only NSC Records Management System profile sheets describing the attached documents. The NSC Cables, Emails, and Records Management System contains relevant material. This consists of a press briefing and draft correspondence between President Clinton and Senator Arlen Spector and Senator John Kerry regarding the media leaks.

Records that are responsive to this FOIA request were found in these collection areas: Clinton Presidential Records: White House Staff and Office Files and Clinton Presidential Records: NSC Cables, Emails, and Records Management System. In this FOIA, Staff and Office files were not processed at the folder level, that is, individual documents were selected and removed from a folder for processing. For this specific FOIA, folder level processing would have resulted in the incidental processing of documents that are not wholly responsive to the subject area.

Access to Clinton Presidential Records is governed by the Presidential Records Act (PRA) (44 USC 2201) and the Freedom of Information Act (FOIA) (5 USC 552, as amended) and therefore records may be restricted in whole or in part in accordance with legal exemptions.
