This segment primarily deals with the executive clemency granted by President Clinton to eleven Puerto Rican FALN (Armed Forces of National Liberation) /Machetero members in September 1999. Elizam Escobar, Ricardo Jimenez, Adolfo Matos, Dylcia Pagan, Alicia Rodriguez, Ida Luz Rodriguez, Luis Rosa, Carmen Valentin, Alberto Rodriguez, Alejandrina Torres, and Edwin Cortes were released with conditions in September 1999 after serving an average of 19 years in state and federal prisons. An additional two individuals who were already on parole, Roberto Maldonado-Rivera and Norman Ramirez-Talavera, had their unpaid fines remitted. Most of the prisoners were charged with seditious conspiracy which had significantly lengthened their sentences. Public sentiment fell into two camps, for clemency and against. The “for” clemency camp held that the men and women were in effect no different than other political activists such as Nelson Mandela in attempting to free Puerto Rico from the United States of America. The “for” camp was further divided into two main splinters, one demanding full unconditional release for all 16 Puerto Rican FALN/Machetero “political” prisoners being held in federal custody and the second, who favored conditions be placed on the prisoners to foreswear any further violence. Many notable personages were listed as supporting clemency including former President Jimmy Carter and Bishop Desmond Tutu. The “against” camp called the prisoners terrorists and likened them to the Unabomber and the people associated with the World Trade Center bombings in February 1993. Many law enforcement organizations claimed that even though the prisoners were not charged with injuring or killing anyone, clemency sent a “dangerous” message to would-be terrorists. The Republican-led Congress launched an investigation into the President’s grant of clemency which resulted in a Bates run (series CL) numbering close to 17,000 pages and a lengthy report. The records consist of articles, drafts, emails, legislation, letters, meeting notes, memos, petitions, press releases, reports, statements, subpoenas, talking points, and transcripts. Subjects include clemency, commutation, executive privilege, pardons, prisons, Puerto Rican independence, sentencing, United Church of Christ, and Vieques. When the President grants a commutation of sentence, which he did for the individuals listed above, the sentence is totally reduced or partially reduced. The applicant must have started serving the sentence and not be challenging the conviction in the courts. Commutation of sentence does not change the conviction status, imply innocence, or remove civic issues associated with criminal conviction. Once commutation is granted, an applicant may be released from part of his or her financial obligations that were imposed as part of the sentence. Commutations have no effect on immigration status.
