The United States Constitution grants the power to pardon or commute sentences to all sitting U.S. Presidents. President Clinton pardoned, commuted or rescinded the convictions of 459 people during his term in office. The collection contains correspondence, memoranda, reports, forms, notes, and news articles all relating to the recommendations, approvals, or denials of pardons and clemencies. Scope and Content Note The materials in FOIA 2006-1704-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. Segment 1 of FOIA request 2006-1704-F contains materials relating to presidential pardons and clemencies. Pardoning or commuting sentences is a power granted by the U.S Constitution to all sitting United States Presidents. Presidents have the power to grant clemency in one or more of the following ways: the ability to grant a full pardon, commute a sentence, or to rescind a fine. The difference between a pardon and a commutation are: a pardon is an executive order vacating a conviction where a commutation or remission is the lessening of a penalty without forgiveness for the crime; the individual is still considered guilty of the offense. Approximately 20,000 pardons and clemencies were issued by U.S. presidents in the 20th century alone. President Clinton pardoned, commuted or rescinded the convictions of 459 people during his term. Most notably among them are: Roger Clinton, Susan McDougal, Patty Hearst, Mel Reynolds, Henry Cisneros, Dan Rostenkowski, Samuel Loring Morison, Rick Hendrick, John Deutch, and Henry O. Flipper, the first black West Point cadet who was found guilty of "conduct unbecoming an officer" in 1882. On his last day in office, January 20, 2001 President Clinton issued 140 pardons as well as several commutations. The records in this FOIA contain correspondence, memoranda, reports, forms, notes, and news articles relating to pardons and clemencies. The correspondence is from the Department of Justice (DOJ), attorneys, individuals requesting pardons and/or clemencies and from friends and family members. The forms include copies of petitions for pardon and/or clemency. The memos and reports are from DOJ, white house staff, and attorneys and contain recommendations regarding the approval or denial of pardons and clemencies. In the case of presidential pardons, the Counsel’s Office received a huge amount of correspondence concerning why certain individuals were deserving candidates for President Clinton to grant them executive clemency. A large portion of the records in this FOIA came from the White House Counsel Office files of Meredith Cabe. Record Type Textual System of Arrangement Records that are responsive to this FOIA request were found in these collection areas – Clinton Presidential Records: White House Office of Records Management WHORM Subject Files, Clinton Presidential Records: White House Staff and Office Files. There were 3½” diskettes within this series. The materials from these diskettes have been processed electronically and are available for research in an electronic format. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Subject file was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. Staff and Office Files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area.
