President Clinton appointed two Supreme Court Justices within his first two years in office, Ruth Bader Ginsburg in 1993 and Stephen G. Breyer in 1994. President Clinton was tasked with nominating two Supreme Court justices within his first two years in office. It had been 26 years since a Democratic President had appointed someone to the Supreme Court. President Clinton appointed Justices Ruth Bader Ginsburg in 1993 and Stephen G. Breyer in 1994. In his remarks announcing the nomination of Justice Ginsburg President Clinton said, “Article II, section 2 of the United States Constitution empowers the President to select a nominee to fill a vacancy on the Supreme Court of the United States. This responsibility is one of the most significant duties assigned to the President by the Constitution. A Supreme Court Justice has life tenure, unlike the President, and along with his or her colleagues decides the most significant questions of our time and shapes the continuing contours of our liberty. I care a lot about this responsibility, not only because I am a lawyer but because I used to teach constitutional law and I served my State as attorney general. I know well how the Supreme Court affects the lives of all Americans personally and deeply. I know clearly that a Supreme Court Justice should have the heart and spirit, the talent and discipline, the knowledge, common sense, and wisdom to translate the hopes of the American people, as presented in the cases before it, into an enduring body of constitutional law, constitutional law that will preserve our most cherished values that are enshrined in that Constitution and, at the same time, enable the American people to move forward.” The White House Office of Records Management (WHORM) Subject Files contain correspondence memoranda, clippings, press releases and resumes from individuals, organizations and Congressional leaders making recommendations for Supreme Court nominees. Most of the correspondence and memoranda concentrates on an individual’s accomplishments. The White House Staff and Office Files contain correspondence, handwritten notes, memoranda, e-mails, articles from legal journals, lists, reports and clippings regarding the search for a Supreme Court justice. The majority of the Staff and Office Files are from the Counsel’s Office and contains summaries and profiles of the potential candidates. The judicial selection process for the first two years of the Clinton administration was run by the White House Counsel’s office and a group of officials from the Department of Justice. The White House Office of Records Management (WHORM) contains a variety of series created to organize and track documents and correspondence. The WHORM Subject file was compiled by the White House Office of Records Management and is a series of categories designated by a letter/number combination. Staff and Office files were maintained at the folder level by staff members within their individual offices and document all levels of administration activity. WHORM files are processed at the document level; whereas, Staff and Office files are processed at the folder level, that is, individual documents are not selected and removed from a folder for processing. While this method maintains folder integrity, it frequently results in the incidental processing of documents that are not wholly responsive to the subject area.
