This researcher submitted a FOIA request for material related to a memorandum of agreement (MOA) dated no later than August 28, 1996, concerning certification of the United States Enrichment Corporation (USEC) and involving the Departments of State and Energy and the National Security Council. Responsive records were found in a packet in NSC Records Management and consist of an undated predecisional draft MOA, supporting transmittal memos and routing sheets dated mid July 1996, a draft committee charter, and a discussion paper. The MOA is a contract between the US government and the USEC to buy HEU from the Russian Federation that had been distilled from disarmed nuclear weapons. The charter lays out the responsibilities for a new committee on HEU oversight established to monitor USEC going forward. The discussion paper enumerates the pros and cons of USEC’s privitization.
