During the administration this procedure came under investigation by a number of entities and became known popularly as “Filegate.” This collection contains a large number of records from the White House Counsel Office. It includes correspondence related to the various investigations and administrative paperwork related to records management and records production. The files also include personnel records, correspondence related to personnel security, approval for White House passes, and administrative paperwork related to monitoring those activities. The collection also includes records related to a lawsuit brought by Judicial Watch that was also referred to as “Filegate.” Scope and Content Note The materials in FOIA 2006-1066-F are a selective body of documents responsive to the topic of the FOIA. Researchers should consult the archivist about related materials. A majority of the records produced for this FOIA were from personnel files which resulted in many closures related to personal privacy. Additionally many of these records are related to Kenneth Starr’s Office of Independent Counsel investigation and are closed under the exemption 3, Federal Rule of Criminal Procedure 6(e). This collection is primarily records of the White House Counsel’s Office. It includes records from staff members: David Apol, Peter Belk, Ann Bushmiller, Chris Cerf, Michael Imbroscio, Clifford Maunton, Miriam Nemetz, Mike O’Connor, Erin Peterson, Kathy Ruemmler, Charles Ruff, Jane Schaffner, Jane Sherburne, Greg Smith, and Wendy White. The records in the collection date from 1993 to 2000. They include correspondence between the counsel office and Senate and House committee, the Federal Bureau of Investigation (FBI), the Government Accounting Office (GAO), the Department of Justice and others. Much of this collection is related to document production for the various investigative committees. This collection contains correspondence, email, memoranda, and notes related to the vetting and pass procedure for the White House. The collection includes documents related to Cara Leslie Alexander et al v Federal Bureau of Investigation et al. White House Staff and Office files and email from the National Security Council (NSC) include correspondence related to personnel security, approval for White House passes, and administrative paperwork related to monitoring those activities. Email discusses “Filegate” and personnel security changes following “Filegate.” Automated Records Management System [Email] (ARMS) records include emails from Craig Livingstone discussing background or vetting investigations that involved the FBI or FBI files. ARMS records also include an email sent to Craig Livingstone from Counsel that discusses procedures for background or vetting investigations. In May 1993 seven members of the White House Travel Office were fired for what the White House claimed was financial improprieties. On May 12, 1993, William Kennedy, Associate White House Counsel, asked the FBI to investigate travel office finances. This was at the same time that the White House was conducting its own audit of the office. The FBI released its report on the issue in May 1993. A few weeks later, July 3, 1993, the White House released a strongly critical report on its own investigation of the travel office matter. The investigations that followed would later be colloquially known as “travelgate” and “filegate.” Mack McClarty and Leon Panetta, authors of the July 1993 report, wrote "Mistakes were made -- mistakes of judgment, mistakes of inexperience that included inappropriate actions with respect to the F.B.I., allowing the appearance that personal interest and favoritism could play a role in management decisions, and unfair treatment of White House employees." The two offered apologies to the seven travel office employees who were fired and offered different jobs in the administration to all of them. Congress called for an investigation by the GAO. The GAO began investigations in July 1993 and later that same month Vince Foster committed suicide. Robert B. Fiske, Jr. was appointed as special prosecutor to investigate if there was a connection between Foster’s death and the events in the travel office. The GAO released their report, titled “Personnel Security: Pass and Security Clearance Data for the Executive Office of the President.” in October 1995 and stated that the White House had legal authority to fire the employees but hinted that First Lady Hillary Clinton may have had a bigger role to play in the firings. Independent Counsel Kenneth Starr was given expanded authority to investigate the travel office firings in August 1994. Following the elections in November 1994 the United States Congress and the Senate became controlled by Republican majorities. William Clinger, Chairman of the House Government Reform and Oversight Committee, began a committee investigation into the travel office firings. During this course of investigation, this Committee obtained documents subpoenaed from White House Counsel. One of the documents, the Federal Bureau of Investigation background file of Billy Ray Dale, was produced to the committee. In June 1996, Clinger announced that his committee had discovered the presence of these files. Inquiries into why the White House had the background file led to the discovery of other FBI files in the security office. As a result of the ongoing investigations of the House Government Reform and Oversight Committee, the Committee began investigating the White House’s access to FBI files in June 1996. The investigation merged into what most people began calling “Filegate” and focused on the White House’s handling of FBI files in 1993 and 1994. The Travel Office firings and the FBI files matter, or some related matter, were investigated by: The GAO, the Department of Justice, the FBI, the House Government Reform and Oversight Committee, the House Ways and Means Committee, the House Treasury Committee, the House Permanent Select Committee on Intelligence, the Senate Committee on the Judiciary, and no fewer than five times by the Office of Independent Counsel. Independent Counsel Robert Ray released his final reports in March and October 2000. Ray announced the termination of his Independent Counsel January 19, 2001. Record Type Textual System of Arrangement Records that are responsive to this FOIA request were found in the following collection areas—Clinton Presidential Records: White House Staff and Office Files, Clinton Presidential Records: Automated Records Management System [Email], and Clinton Presidential Records: NSC Cables, Email, and Records Management System. Staff and Office Files were maintained at the folder level by staff members within their individual offices and documents all levels of administration activity. The Automated Records Management System (ARMS) is a database that contains email records of the Executive Office of the President. This system maintained unclassified Presidential email. The ARMS database is comprised of six sub-series of email records called "buckets." The buckets generally represent a specific White House office. The buckets are titled: NPR for National Performance Review, OPD for Office of Policy Development, POTUS for President of the United States, WHO for White House Office, CEA for Council of Economic Advisers, and Default for emails not associated with an office. The NPR bucket contains email created or received by an individual with a National Performance Review (NPR) White House user account. The OPD bucket contains email created or received by an individual with an Office of Policy Development (OPD) White House user account. The POTUS bucket was designated for email created and received by the President of the United States (POTUS). Please note that President Clinton never used his POTUS White House user account to send the few emails he wrote while in office. The WHO bucket contains email created or received by individual with an Executive Office of the President White House user account not identified as CEA, NPR, or OPD. The CEA bucket contains email created or received by an individual with a Council of Economic Advisors (CEA) White House user account. The Default bucket contains email created or received by unknown or un-recognized email accounts. Email found within the Default bucket often includes email created or received by offices or individuals outside the Executive Office of the President. ARMS emails are arranged by topic, there-under by bucket, and there-under chronologically by creation date. Access Collection is open to all researchers. Access to Clinton Presidential Records is governed by the Presidential Records Act (PRA) (44 U.S.C. Chapter 22, as amended) and the Freedom of Information Act (FOIA) (5 U.S.C. 552, as amended) and therefore records may be restricted in whole or in part in accordance with legal exemptions.
